Welcome to HotelMapping.ai (“Company,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services, including hotel and room-type mapping, provider-code mapping, and de-duplication tools (collectively, the “Service”). By creating an account, purchasing a subscription/credits, or using the Service, you agree to these Terms.
Important upload attestation. If you upload or provide any Source Data, Target Data, or third-party datasets to the Service (e.g., GIATA, Vervotech, Hotelbeds, GoGlobal), you confirm you have the legal right to do so and you accept full responsibility for that data. We are not a party to your agreements with any third-party data provider.
You must be able to form a binding contract and comply with these Terms. You’re responsible for your account credentials and all activity under your account.
The Service helps you map hotel properties and room types across sources, map against specific providers, and de-duplicate lists. You upload data files (e.g., CSV, XLSX, JSON, XML) and receive mapping candidates/results generated by our algorithms and workflows.
Definitions. “Customer Data” means any files, datasets, or information you upload or otherwise provide to the Service, including Source Data and Target Data used for mapping, de-duplication, or enrichment (e.g., hotel catalogs, room types, geodata, and third-party datasets such as GIATA, Vervotech, Hotelbeds, GoGlobal, etc.).
Your ownership; our limited use. You retain all rights in Customer Data. You grant us a non-exclusive, worldwide, royalty-free license to host, process, transform, and display Customer Data solely to provide, maintain, secure, and improve the Service (including quality assurance, troubleshooting, and usage analytics). We do not use Customer Data to train publicly available models.
Rights & permissions warranty. You represent and warrant that you (i) have obtained all rights, permissions, and licenses necessary to upload, provide, and use Customer Data with the Service; (ii) your use of the Service with Customer Data complies with all applicable laws and all third-party terms that govern such data (including vendor contracts and IP restrictions); and (iii) Customer Data does not infringe or misappropriate any third party’s rights or breach any confidentiality obligations.
Third-party datasets. If you upload or share any third-party dataset with us, you remain solely responsible for ensuring your use—and our processing under your instructions—is permitted by your agreement with that third party. We do not acquire any rights in such datasets and are not a party to your third-party contracts.
Sensitive/personal data. You are responsible for ensuring you have a lawful basis to include any personal data within Customer Data and for providing any required notices. We do not require personal data to perform hotel/room mapping. Do not upload special categories of personal data unless strictly necessary and permitted by law.
Takedown procedure. If we receive a complaint or credible notice that Customer Data may be unauthorized or infringing, we may request proof of rights, suspend processing, or remove the affected data. Where feasible, we will notify you and provide a reasonable opportunity to respond before removal.
Data deletion. Upon your request or at the end of your subscription, we will delete or return Customer Data in accordance with our retention practices, except where we must retain data to comply with law, resolve disputes, or enforce agreements.
Indemnification for Customer Data. You will defend, indemnify, and hold harmless HotelMapping.ai, its affiliates, and their officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to Customer Data, including any allegation that Customer Data (or our processing of it under your instructions) (a) infringes IP or other rights, (b) violates law, or (c) breaches your obligations to a third party (including any dataset vendor).
Mapping outputs are probabilistic and may contain errors. You are responsible for validating results for your business use. We may provide confidence scores and manual review workflows; we do not warrant completeness or accuracy.
You agree to:
• not engage in illegal, infringing, harmful, or deceptive activity;
• not bypass security, scrape at unreasonable rates, or reverse engineer;
• not upload malware or content that violates third-party rights or laws.
We offer subscription plans and/or credit packs. Credits are consumed by processing actions (e.g., per-row, per-selection) as shown in the app. Unless otherwise stated, credits are non-transferable, non-refundable, and may expire per your plan or grant terms. Prices exclude taxes unless specified; applicable taxes (e.g., VAT/GST) may be collected by our payment provider.
Payments may be processed by Paddle.com acting as Merchant of Record, or by other providers (e.g., Lemon Squeezy). When Paddle processes your transaction, Paddle.com Market Ltd. (and its affiliates) is the seller of record and handles invoicing, tax, and certain payment support/returns. You agree to the relevant checkout terms shown at purchase.
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal within the app. Upon cancellation, your subscription remains active until the end of the current paid term; you will not be charged again. Certain features may cease to function at the end of the term.
Our refund approach is described in our Refund Policy. Where a payment provider (e.g., Paddle) applies its own refund/consumer terms, those will also apply.
Each party will protect the other party’s non-public information with reasonable care and use it only for purposes of this Agreement.
We (and our licensors) own the Service, underlying software, models, heuristics, and documentation. You receive a limited, non-exclusive, non-transferable license to access and use the Service during your subscription in accordance with these Terms.
If you provide feedback or suggestions, we may use them without restriction or compensation.
Certain features may be labeled beta or experimental and are provided “as is,” may change, and may be discontinued.
We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable. We may suspend accounts for breach, security risk, or suspected abuse.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THAT PERIOD. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (E.G., WILLFUL MISCONDUCT).
You will indemnify and hold us harmless from claims or losses arising from (a) your Customer Data, (b) your breach of these Terms, or (c) your use of the Service in violation of law or third-party rights.
You will comply with applicable laws, including data protection, sanctions, and export control rules.
These Terms are governed by the laws of Türkiye, without regard to conflict-of-laws rules. The courts and enforcement offices of Istanbul, Türkiye will have exclusive jurisdiction and venue for disputes, and the parties consent to personal jurisdiction there.
We may update these Terms. Material changes will be notified via the Service or email. Continued use after the effective date constitutes acceptance.
You may not assign these Terms without our prior written consent; we may assign to an affiliate or in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays/failures due to events beyond reasonable control. If any provision is held invalid, the remainder remains in effect. These Terms (plus any order form/plan terms and referenced policies) are the entire agreement. Sections that by nature should survive (including 3, 4, 9–17, 19, 21) survive termination.
